Proposition 65, also called the Safe Drinking Water and Toxic Enforcement Act, was enacted by the State of California in 1986. The act requires “clear and reasonable” warnings about potential exposures to certain chemicals that California has determined cause cancer, birth defects or other reproductive harm. 

Under the current rules, the warnings had to be shown on the product and/or the product’s packaging. However, Proposition 65 has recently been amended to also include “pre-purchase” warning requirements. The amendments take effect on August 30, 2018. In addition to on-product warnings, catalogs and webpages must now carry the same warnings so that consumers in California can see the warnings prior to purchase.

The California Safe Drinking Water and Toxic Enforcement Act, better known as Proposition 65, lists over 775 chemicals that are known to cause cancer and/or birth defects or other reproductive harm. Proposition 65 requires manufacturers to provide a “clear and reasonable” warning before knowingly and intentionally exposing anyone to a listed chemical. A “clear and reasonable” warning indicates: 

(1) That the manufacturer has evaluated the exposure and has concluded that the product contains a listed chemical that exceeds the “no significant risk level” (as defined in Proposition 65) 

(2) The manufacturer has chosen to provide a warning simply based on the knowledge about the presence of a listed chemical without attempting to evaluate the exposure. As we have over 600 active products (not including component parts) that are continuously being improved upon, it is not feasible for us to test every single component of every single unit manufactured for the presence and exposure level of a Proposition 65 chemical. UltraTech International, Inc. has chosen to provide a warning based on the premise that one or more of the chemicals listed may be present in specific parts. With UltraTech International’s products, the exposure may be below the Proposition 65 levels of concern, or could even be zero. However, since our business is focused on environmental stewardship and out of an abundance of caution, UltraTech International, Inc. has elected to publish this notice.
